4. A Petition under Section 9 of the Insolvency and Bankruptcy Code, 2016 has been admitted by the National Company Law Tribunal, New Delhi on 27.09.2017. Since that date, by way of a Memorandum of Understanding dated 16.12.2017, the matter has been settled between the parties.
5. A copy of the Memorandum of Understanding dated 16.12.2017 executed between the parties is made part of the record of this Court, and by using our powers under Article 142 of the Constitution of India, we set aside the impugned order dated 27.09.2017 passed by the National Company Law Tribunal.
6. Accordingly, the appeal is disposed of.
7. Pending applications filed in the matter also stand disposed of.
