This appeal arises from a judgment of a Division Bench of the High Court of Judicature for Rajasthan at Jodhpur dated 2 April 2008.

We have heard Mr. Jayanth Muthuraj, learned counsel for the appellant as well as Mr. S. Raja Rajeshwaran, learned counsel appearing on behalf of the respondent - State.

None has appeared on behalf of the respondent State in spite of due service of notice. We have heard the learned counsel for the petitioner.

Leave granted.
