1. Learned counsel for the petitioner says that the High Court was right in holding that the writ petition was not maintainable. However, it was not appropriate to go into the merits of the case after coming to the conclusion that the writ petition was not maintainable.

2. In that view of the matter, we uphold the view taken by the High Court that the writ petition was not maintainable and leave it to the petitioner to avail of such other remedy as may be permissible in law without being constrained by the observations of the High Court.

3. The special leave petition stands disposed of.
