WRIT PETITION (CIVIL) NO. 1329 OF 2021

1. This writ petition has been filed seeking a direction to the respondents, to declare a defined criteria for arriving at seat matrix for the institutional preference candidates. Further, a direction is sought for roster wise/discipline wise seat allocation for institutional preference candidates who seek admission via INI-CET examination.

2. The petitioner No. 1 is a registered Association of Students of All India Institute of Medical Sciences (AIIMS), Bhopal and the other petitioners are candidates who have appeared for INI-CET examination. The grievance of the petitioners is that they are losing out on their preferred discipline as no mechanism for allotment of seats for institutional preference is specified. It has been brought to our notice, that a roster system has been adopted at JIPMER, Puducherry and the same may be followed for admissions to all the AIIMS institutions.

3. Counter affidavit has been filed on behalf of the All India Institute of Medical Sciences (AIIMS), New Delhi, in which it has been stated that a roster point based reservation can be followed for preferential candidates. However, the actual roster point for AIIMS would be different from that of Jawaharlal Institute of Postgraduate Medical Education and Research (JIPMER).

4. Accepting the submissions made on behalf of AIIMS, we direct that the roster point-based reservation for preferential candidates as followed by JIPMER shall be implemented in all the AIIMS institutes. However, the roster points need not be similar to that of JIPMER. This order shall be applicable for admission from this year.

5. Writ petition stands disposed of. Pending application(s), if any, shall also stand disposed of.
