Without prejudice to the contentions available to both sides, we are of the view that an attempt should be made to see whether M/s. Raj Doshi Exports Pvt. Ltd.- petitioner No. 1 in SLP (C) No. 11678/2016 commands the required 70% consent of the tenants/occupants.

1. Without prejudice to the contentions available to both sides, we are of the view that an attempt should be made to see whether M/s. Raj Doshi Exports Pvt. Ltd.- petitioner No. 1 in SLP (C) No. 11678/2016 commands the required 70% consent of the tenants/occupants.

2. We direct the Chief Officer, Mumbai Building Repairs and Reconstruction Board (MBRRB) to call for a meeting of the tenants/occupants and ascertain whether the said petitioner has 70% consent. This shall be done within a period of four weeks from today.

3. List after six weeks.
