1. Nobody appears on behalf of the appellant. This has been the position on the earlier occasion also. In these circumstances, we find no other option but to go ahead with the matter with the assistance of the learned counsel for the respondent. After perusing the judgment of the High Court, we feel that some assistance is required. Since nobody is appearing on behalf of the appellant, we, therefore, request Mr. Basava Prabhu Patil, learned senior counsel, who is present in the court, to assist the Court as Amicus Curiae on behalf of the appellant, who shall be assisted by Mr. Abhimanyu Bhandari, advocate. Mr. Basava Prabhu Patil, learned senior counsel and Mr. Abhimanyu Bhandari acceded to our request.
2. The Registry is directed to supply copies of the paper book of the matter forthwith to Mr. Basava Prabhu Patil, learned senior counsel as well as Mr. Abhimanyu Bhandari, learned counsel.
