1. We are not at all satisfied with the order passed by the High Court particularly the direction that the matter should be taken up by this Court on an application for clarification to be moved by the petitioner.

2. Under the circumstances, we set aside the order passed by the High Court and remand the matter to the High Court for reconsideration on merits and passing appropriate orders.

3. The special leave petition is disposed of.

4. It is made clear that we are not expressing any opinion on the merits of the case.
