Order

1. Permission to file SLP granted.

2. Issue notice returnable on 18th September, 2018.

3. Notice may also be served on the State of Bihar.

4. Dasti, in addition, is permitted.

5. Ms. Aparna Bhat, learned amicus curiae accepts notice and she has drawn our attention to the order dated 29th August, 2018 passed by the Patna High Court in Saleem Madavoor v. State of Bihar1.

6. In para 4 of the order, it is mentioned that Miss Prakritita Sharma is appointed as amicus curiae and she is requested to visit the places where the victims are at present kept/accommodated and interact with them and submit a report on their rehabilitation. The Bihar State Legal Services Authority is directed to provide required facilities to the amicus curiae to visit the places and the expenses thereafter shall be borne by the Government.

7. This is totally in conflict with our earlier orders. Therefore, we have no option but to stay the above order of the Patna High Court.

8. A copy of the order shall be sent immediately to the Registrar General of the Patna High Court.
