Civil Appeal No. 6945/2015
1. Heard Mr. Shish Pal Laler, learned counsel appearing for the appellants and Mr. R.K. Kapoor, learned counsel for the respondents.
2. Having heard learned counsel for the parties, we are not inclined to enhance the amount awarded by the High Court, for we find it just and reasonable.
3. In view of the aforesaid, the appeal sans merit and is dismissed.

4. In the course of hearing, a suggestion was given to Mr. Dinesh Chandra Pandey, learned counsel appearing for the appellants whether the enhancement of the amount by Rs. 5,00,000/- (Rupees five lacs only) will satisfy the claim put forth in the appeal. Learned counsel accepted the same. Mr. Vishnu Mehra, learned counsel appearing for the respondent-insurance company, left it to the discretion of the Court.
5. In view of the aforesaid, the amount awarded is enhanced by Rs. 5,00,000/- (Rupees five lacs only) with the stipulation that the same shall be deposited before the Tribunal within twelve weeks hence, failing which it shall carry interest at the rate of 9% per annum from the date of application before the Tribunal. The amount deposited shall be disbursed in favour of the appellants on proper identification.
6. With the aforesaid modification in the award passed by the tribunal, which has been further modified by the High Court, the appeal stands disposed of. There shall be no order as to costs.
