Order

1. We have heard learned counsel for the parties.

2. Considering the facts and circumstances of the case including the fact that the appellant (Md. Sajjad @ Raju @Salim) has been in custody for about 10 and ½ years, we think that this is a fit case for grant of bail.

3. Accordingly, the appellant is granted bail subject to furnishing a personal bond for an amount of Rs. 25,000/- along with one surety of the like amount to the satisfaction of the Trial Court.

4. Accordingly, application for bail is disposed of.

5. Learned counsel for the State points out that since the original record of the case is lying in this Court, the trial in respect of other accused who were absconding (but are now available) is not being taken up.

6. The Registry is directed to send the original record of the case to the Trial Court. However, the State should file the deposition of the witnesses for the purposes of hearing of this appeal within six weeks. Learned counsel for the State is permitted to inspect the record for the aforesaid purpose.
