Order
1. Heard learned counsel for the petitioner.
2. By the order of the High Court dated 27.08.2018, the petitioner was directed to pay Rs. 75,00/- (Rupees seven thousand five hundred) per month as damages for use and occupation from 17.01.2008 to 31.12.2017 and, thereafter, she was directed to pay Rs. 15,000/- (Rupees fifteen thousand) per month.
3. According to the learned counsel for the petitioner she was not in a position to mobilize the funds and comply with the direction of the High Court. Counsel for the petitioner has submitted that as per the direction of the High Court, the total amount works out to Rs. 10,80,000/- (Rupees ten lakhs eighty thousand) and the petitioner is now ready with the money to deposit before the High Court.
4. In this regard learned counsel has also produced the Demand Drafts for Rs. 10,80,000/-.
5. Having regard to above, issue notice returnable by four weeks.
6. In the meantime, there shall be stay of the eviction order passed by the Trial Court subject to the condition that the petitioner shall deposit the amount of Rs. 10,80,000/- before the Delhi High Court with a week. The petitioner shall continue to pay damages of Rs. 15,000/- p.m. to the respondent on or before 10th of every English calendar month.
