The Order of the court was delivered by

Order

1. We are not inclined to interfere with the impugned order passed by the High Court insofar as it relates to the merit of the controversy involved in the case. We are however inclined to interfere in the impugned order only to the extent it imposed a cost of Rs. 25,000/- (Rupees twenty five thousand) on the counsel appearing for the petitioner in the High Court.

2. In our opinion, imposition of cost on the counsel having regard to facts and circumstances of the case, was not justified.

3. We, accordingly, set aside the impugned order which relates to the imposition of costs of Rs. 25,000/- (Rupees twenty five thousand) on the counsel.

4. With this limited modification in the impugned order, this special leave petition stands disposed of.

5. Pending application also stands disposed of.
