The Order of the court was delivered by
Mohan M. Shantanagoudar, J.:—
1. In the judgment passed by the High Court of Judicature for Rajasthan at Jaipur Bench, Jaipur in D.B. Criminal Appeal No. 958 of 2008, the petitioner herein was not a party. At that point of time, the petitioner herein was absconding and it is so mentioned in paragraph 3 of the impugned judgment. Under the mistaken motion, the petitioner has filed a jail petition on the presumption that an adverse order has been passed against him by the High Court.
2. Since, no adverse order has been passed by the High Court against the petitioner herein, the instant petition stands dismissed as pre-mature. However, liberty is given to the petitioner to approach the High Court against his conviction. If the petitioner approaches the High Court by filing an appropriate appeal, if not already approached, the High Court is requested to decide the same at an early date on merits. Needless to mention, that if an adverse order is passed against the petitioner, he shall be at liberty to appraoch this Court.
3. Disposed of in the aforesaid terms.
