2. In view of the fact that Civil Appeal No. 1035 of 2008 having similar legal issue has been allowed by this Court on 01.07.2015, this appeal is also allowed in the same terms with no order as to costs.
3. It has been submitted by the learned counsel for the respondents that the matter is still pending in the High Court. It would be open to the parties to settle the accounts in the High Court and the amount payable shall be determined in the pending proceedings.
