Venkatraman, learned Additional Solicitor General appearing for the appellant and Mr. Rahul Narayan, learned counsel appearing for the respondent and on perusal of the findings/observations made by the Customs Excise Service Tax Appellate Tribunal, West Zonal Bench at Ahmedabad in para 4 of its impugned order dated 29.04.2008, coupled with the peculiar facts and circumstances of this case, we are not inclined to interfere with the impugned order passed by the Tribunal. However, the question of law is kept open.
