Issue notice.

Being aggrieved by the acquittal of the respondents-accused under Section 364-A I.P.C., State of Haryana has preferred this appeal.

After we had passed the order dated in W.P.(Crl.) No. 225/2018 and W.P.(C) No. 1205/2018, two more public interest litigations have been filed on the same issue i.e. W.P.(Crl.) Nos. 297/2018 and 298/2018.

The judgment dated 18.11.2009 passed by the High Court of Judicature at Bombay, Bench at Aurangabad in Criminal Appeal No. 509 of 2007 is called in question in this appeal.

On 22 March 2007, a Division Bench of the Bombay High Court disposed of a reference which was made under Section 366 of the Code of Criminal Procedure 1973 by the 3rd Ad-hoc Additional Sessions Judge, Nasik.

The judgment of the Division Bench of the High Court of Jammu and Kashmir at Jammu in L.P.A. (OW) No. 38/2008 and L.P.A. (OW) No. 39/2008 dated 01.04.2009 is the subject matter of these appeals.
