Being aggrieved by the acquittal of the respondents-accused under Section 364-A I.P.C., State of Haryana has preferred this appeal.

After we had passed the order dated in W.P.(Crl.) No. 225/2018 and W.P.(C) No. 1205/2018, two more public interest litigations have been filed on the same issue i.e. W.P.(Crl.) Nos. 297/2018 and 298/2018.

The judgment dated 18.11.2009 passed by the High Court of Judicature at Bombay, Bench at Aurangabad in Criminal Appeal No. 509 of 2007 is called in question in this appeal.

Leave granted.

On 22 March 2007, a Division Bench of the Bombay High Court disposed of a reference which was made under Section 366 of the Code of Criminal Procedure 1973 by the 3rd Ad-hoc Additional Sessions Judge, Nasik.

We have heard the learned Amicus, the learned Solicitor General appearing for the State of Assam, learned counsel for the applicant as well as learned counsel for the Union of India.
