Order
1. Delay condoned.
2. The main contention advanced by the learned senior counsel appearing for the petitioners is that Respondent No. 2 has not been appointed in terms of Rule 96 of the Delhi School Education Rules. The Division Bench, as per the impugned order in the Review and also in the original Judgment, has dealt with this contention and has taken the view that as per the direction of the Society, Respondent No. 2 has been appointed in the school and he has been treated as an employee of the school for all purposes.
3. The High Court has also reproduced his pay-scale and the benefits granted to him as a regular employee of the school. We are also informed that he has worked for six years in the school. Still further, we learn that the Education Department has not taken an objection regarding his appointment in the school.
4. In that view of the matter, we do not think any substantial injustice has been caused to the petitioner, though technically, there may be some force in the contention that the initial appointment was not made as per the procedure contemplated in the Rules.
5. These Special Leave Petitions are dismissed accordingly.
6. Pending interlocutory application(s), if any, is/are disposed of.
