1. It is submitted by Mr. Nikhil Jain, learned counsel for the petitioner that her statement under Section 161 of the Code of Criminal Procedure has not yet been recorded though charge-sheet has been filed.
2. In view of the aforesaid statement, we direct respondent No. 7 – Superintendent of Police, Collectorate Complex, Mahal Chowk, Alwar, Rajasthan to look into the matter whether the petitioner/the real victim has been examined as required under the Code of Criminal Procedure or not. If she has not been examined, the said procedure shall be completed and if required, additional charge-sheet, as contemplated under Section 173 of the Code of Criminal Procedure, be filed.
3. With the aforesaid direction, the writ petition stands disposed of.
4. As a sequel to the above, pending interlocutory application also stands disposed of.
