Rais Ahamed Khan _________________________________ Petitioner
v.
The State of Madhya Pradesh & Anr. _______________ Respondent(s)
Special Leave Petition (Civil) Diary No(s). 21620/2018, decided on July 10, 2018
(IA No. 86053/2018-Condonation of Delay in Filing and IA No. 86054/2018-Exemption From Filing O.T.)
The Order of the court was delivered by
Order
1. Heard learned counsel for the petitioner and perused the relevant material.
2. Application for exemption from filing official translation is allowed.
3. Delay condoned.
4. The order impugned is passed in a Letter Patents Appeal holding the same to be not maintainable. Though in view of the decision of this Court in ‘State of Madhya Pradesh v. Visan Kumar Shivcharan Lal’ reported in (2008) 15 SCC 233 the Letter Patents Appeal would be maintainable, yet we are not inclined to interfere as we have thought it proper to examine the matter on merits. On such examination we find no infirmity in the order of the learned Single Judge which was assailed in the Letter Patents Appeal.
5. The special leave petition is consequently dismissed.
