1. Learned counsel for the petitioners submits that the High Court has itself noticed that the petitioners had collected the deposits from forty-five depositors and re-paid the said amount only to seven of them. It is further stated in the Order itself that the remaining thirty-eight depositors have not been paid. He further submits that the petitioners are ready and willing to repay/refund the sum deposited along with interest that has been accrued thereupon to the depositors. He further submits that the petitioners have already deposited a sum of rupees sixty two lakhs which is lying to the credit of O.A. No. 5 of 2008 on the file of the Special Court and the petitioners are ready to deposit the further amount. Further, the petitioners had also deposited another rupees seven lakhs as condition for bail. Thus, a sum of rupees sixty nine lakhs is already available in the Court.
2. Let the balance amount, in order to discharge their liability completely qua those thirty eight depositors, be deposited with the trial court.
3. We are of the opinion that the aforestated offer be made before the trial court by the petitioners and since the petitioners are ready to refund the entire amount along with interest to the depositors, the trial court shall undertake the aforesaid exercise of disbursement of the amount. Once the amounts are duly paid to the depositors, the trial court may take a call insofar as attachment of the property of the petitioners is concerned.
4. Learned counsel further submits that the petitioners are also willing to sell properties mentioned as item Nos. 5, 8 and 19. This request shall also be made to the trial court.
5. With the aforesaid observations and directions, the Special Leave Petitions stand disposed of.
6. Pending applications, if any, also stand disposed of.
