Order
1. The petitioner-accused is facing conviction in a number of cases. The question raised by the petitioner is whether the sentences of imprisonment imposed upon him are to run concurrently. Mr. Anish Kumar Gupta, learned counsel appearing for the petitioner who has been appointed through Supreme Court Legal Services Committee, has obtained the details of the cases and the conviction insofar as five cases, which according to learned counsel, he was able to obtain from the Central Jail, Mandoli, Delhi. Learned counsel for the petitioners has submitted that though he was able to meet the petitioner, he could not collect all the relevant details. It was also submitted by learned counsel for the petitioner that he could not gather details of cases from Tihar Central Jail, Delhi.
2. Considering the submission and having regard to the point raised in the special leave petition, the concerned Probation Officer concerning the area (Sawroop Nagar, Delhi) shall file a report containing the following details :
(i) The family background of the petitioner and about his relatives;
(ii) Whether the petitioner has sufficient roots in the family and whether he and his family members have normal avocation in life and give the details thereof;
(iii) Any other relevant details pertaining to the petitioner.
3. The Director General of Prisons, Tihar Central Jail, Delhi, is directed to furnish the details of the cases pertaining to the petitioner in a tabular chart i.e. (i) FIR NO. _______; (ii) Conviction, if any, ______; if that be so (iii) Details of the sentence of imprisonment imposed upon the petitioner ________;
(iv) period of sentence of imprisonment undergone by the petitioner in the Central Tihar Jail and the relevant details thereof _______.
4. The Director General of Prisons, Tihar Central Jail, Delhi and the area Probation Officer, Sawroop Nagar, Delhi, shall file their respective report containing all the details, as above, on or before 17.01.2020.
5. List the matter on 20.01.2020.
6. The Registry is directed to forward a copy of this Order to the Director General of Prisons, Tihar Central Jail, Delhi and also a copy of the Order to the area Probation Officer, Sawroop Nagar, Delhi.
