Order
1. Issue involved in this matter is whether Section 143-A introduced by the Amendment Act No. 20 of 2018 in the Negotiable Instruments Act, 1881 has retrospective application or not?
2. Issue notice, returnable in four weeks.
3. We also issue notice to the State of Tamil Nadu. A copy of the petition be served upon the learned Standing Counsel for the State of Tamil Nadu.
4. As an interim measure, we direct the petitioner to deposit the sum, namely 15% of the cheque amount, in CC No. 7171 of 2018 in the II Fast Track Court – Metropolitan Magistrate, Egmore at Allikulam, Chennai.
5. The money shall be deposited within three weeks from today.
6. Upon deposit, the money shall be invested by the Court in question in a fixed deposit initially for a period of three months with auto renewal facility. The money shall not be made over to the other side till further orders.
7. The matter will be decided on the next date of hearing.
