Order

1. We have heard Shri Siddharth Dave, learned senior counsel, appointed by us as Amicus Curiae, vide order dated 16-07-20201, to assist us in this case.

2. We find that for some technical reason, notice could not be issued to the Union of India. We direct the Registry to hand over the papers to standing counsel for the Union of India. The Union of India to file its affidavit in reply not later than 07th September, 2020.

3. We request Shri K.K. Venugopal, learned Attorney General of India, not only to appear on behalf of the Union of India but also to assist us in this case.

4. In our order dated 16.07.2020, we had referred to our judgment reported in Shafhi Mohammad v. State of H.P.2 Paragraph 14 of which reads as follows:

“14. Compliance with above directions may be ensured by the Secretary, Ministry of Home Affairs in the Central Government as well as Home Secretaries of all the State Governments. An affidavit of progress achieved may be filed by the Oversight Body on or before 31-7-2018. Put up the matter for further consideration on 1-8-2018.”

5. The Registry is directed to place before this Court, all affidavits that are referred to in this paragraph.

6. Registry to give all papers pertaining to this case including the affidavits/reports aforementioned to Shri Siddharth Dave, learned senior counsel, who has been appointed Amicus Curiae by us.

7. Interim relief in the SLP declined.

8. The matter to come up on 16th September, 2020.
