1. We have perused the report of the State Coordinator for National Registration, NRC, Assam dated 30th August, 2017. Having perused the said report we are, prima facie, of the view that Shri Abhijit Sarma who represents the petitioner – Assam Public Works in Writ Petition (Civil) No. 274 of 2009 has committed contempt of Court. We, therefore, direct the Registry of this Court to register a suo motu contempt petition.
2. Issue notice to the alleged contemnor requiring him to show cause within a period of four weeks from today. Copy of the report of the learned State Coordinator for National Registration, NRC, Assam dated 30th August, 2017 along with all enclosures be furnished to the alleged contemnor.
3. We request the learned Solicitor General of India to assist the Court in the matter for which purpose the Registry of this Court is directed to furnish a copy of the report of the learned State Coordinator for National Registration, NRC, Assam dated 30th August, 2017 along with all enclosures to the office of the learned Solicitor General.
4. We have perused the communication dated 10th August, 2017 of the Ministry of Home Affairs, Department of Border Management, Government of India which has been placed before the court in a sealed cover by the learned Solicitor General. We request the learned Solicitor General to suggest another name in place of Shri G.K. Pillai, I.A.S. (Retd.), former Home Secretary to act as the Chairperson of the Committee for overseeing the fencing work.
5. List the matters on Thursday i.e. 14th September, 2017 at 3.45 p.m.
6. Communication dated 10th August, 2017 of the Ministry of Home Affairs, Department of Border Management, Government of India placed before the Court by the learned Solicitor General shall be kept in a sealed cover.
