1. Leave granted.
2. In this appeal limited notice was issued on 17.08.2015 as is clear from the said order which is re-produced herein below:
“Learned counsel for the petitioner points out that though the respondent was initially appointed as Khalasi on 15.7.1975, however, he remained in this capacity only upto 14.10.1976. Thereafter, he was reengaged after a lapse of 10 years i.e. June, 1985. However, by virtue of the impugned judgment of the High Court, even the period between 1975 to 1985 is to be counted, which according to the learned counsel, is clearly perverse.
Issue notice limited to the extent indicated above.”
3. Learned counsel for the respondent submits that the respondent has no objection if the period between 1975 to 1985 is not counted for the purposes of calculation of pension.
4. On the basis of the aforesaid statement of the learned counsel for the respondent, the order of the High Court is modified to the extent that while counting the period for the purpose of payment of pension, period from 14.10.1976 to June, 1985 shall not be counted and pension shall be calculated and paid to the respondent accordingly.
5. Needful be done within two months.
6. The appeal is disposed of.
