Order
1. Heard learned counsel for the parties.
2. It is again the same situation that the property has not been auctioned as no bidder has turned up on two occasions, nor a penny has been paid by Maharaji Educational Trust to the HUDCO in spite of running Medical College, despite clear and explicit orders of this Court from time to time. In the circumstances, we permit the HUDCO to negotiate with M/s. S.G.S. Construction & Developers Pvt. Ltd. for sale of the property, as may be considered appropriate and for realisation of its dues, as it is holding a charge on property as specified in the judgment passed by this Court. It is admitted that approximately Rs. 10 Crores (Rupees Ten Crores only) was paid under the agreement by S.G.S. Construction & Developers Pvt. Ltd. to Maharaji Educational Trust and that was paid to HUDCO.
3. Let negotiations be made and offer be finalized within 15 days and it be placed before us on the next date of hearing.
