4. A Petition under Section 9 of the Insolvency and Bankruptcy Code, 2016 has been admitted by the National Company Law Tribunal, Bench III, New Delhi on 09.02.2018. Since that date, by way of a Compromise Deed dated 21.02.2018, the matter has been settled between the parties.
5. A copy of the Compromise Deed dated 21.02.2018 executed between the parties is made part of the record of this Court, and by using our powers under Article 142 of the Constitution of India, we set aside the impugned order dated 09.02.2018 passed by the National Company Law Tribunal, Bench III, New Delhi.
6. Accordingly, the appeal is allowed.
7. Pending application filed in the matter also stands disposed of.
