3. The present appeal involves a Settlement that has been arrived at on 07.05.2018 between the appellant and the respondent.

4. A copy of the Terms of Settlement dated 07.05.2018 executed between the parties is made part of the record of this Court, and by using our powers under Article 142 of the Constitution of India, we set aside the impugned order dated 19.04.2018 passed by the National Company Law Tribunal, Kolkata Bench, Kolkata.

5. Accordingly, the appeal is allowed.

6. Pending application filed in the matter stands disposed of.
