A copy of the Terms of Settlement dated 07.05.2018 executed between the parties is made part of the record of this Court, and by using our powers under Article 142 of the Constitution of India, we set aside the impugned order dated 19.04.2018 passed by the National Company Law Tribunal, Kolkata Bench, Kolkata.
5. Accordingly, the appeal is allowed.
