1. Leave granted.
2. The appeal before the National Consumer Disputes Redressal Commission, New Delhi (for short, ‘the National Commission) was dismissed mainly on the ground of delay of 129 days as the delay was not properly explained.
3. Be that as it may, having regard to material on record and the facts and circumstances of this case, we are inclined to grant the appellant herein one more chance of representation before the National Commission.
4. Therefore, the appeal is allowed subject to payment of costs of Rs. 1,00,000/- (Rupees one lac only) by the appellant to the respondent within four weeks from today. The impugned judgment is set aside and the matter is remitted to the National Commission. The National Commission is requested to dispose of the matter within two months from the date of receipt of a copy of this order.
5. Pending applications, if any, stand disposed of accordingly.
