During the course of hearing, it came to our notice that the elections to the Managing Committee of the Om Namo Sujlam Suflam Cooperative Housing Society (for short ‘the Society’) were last held in the year 2008.

The Order of the court was delivered by

Order

1. During the course of hearing, it came to our notice that the elections to the Managing Committee of the Om Namo Sujlam Suflam Cooperative Housing Society (for short ‘the Society’) were last held in the year 2008. The term of the Managing Committee is 5 years and that period has expired.

2. In our opinion, it will be appropriate if elections are held on a regular basis. Learned counsel for the parties are agreed that elections to the Managing Committee of the Society deserve to be held with expedition.

3. Mr. A.N.S. Nadkarni, the learned Additional Solicitor General appearing on behalf of Slum Rehabilitation Authority (SRA) says that the Joint Registrar (Co-operative) which is the competent authority will hold the elections to the Managing Committee of the Society and declare the result on or before 31st December, 2017.

4. We make it clear that no Court will stay the election process and any interim orders having the effect of staying elections so far are deemed to have been vacated with immediate effect.

5. Liberty to apply soon after the results are declared.
