1. Mr. Ranjit Kumar, learned senior counsel appearing for the petitioner, points out that though the issue of catch up was raised before the High Court, the same has not been considered.

2. If that be so, it is for the petitioner to pursue his remedies available to him under law on that issue.

3. Without prejudice to such liberty, these special leave petitions are permitted to be withdrawn.

4. We make it clear that we have not considered the matter on merits.

5. However, it will be open to the parties on both the sides to take all available contentions before the High Court on the point of catch up.
