1. This appeal is directed against the judgment and order dated 12.04.2005 passed by the High Court of Judicature for Rajasthan at Jodhpur in D.B. Criminal Appeal No. 833 of 2001.

2. Heard learned counsel for the parties and perused the relevant material.

3. The respondent, Ratan Lal, was convicted by the Trial Court under Section 302 IPC for causing the death of his wife and was sentenced to suffer life imprisonment.

4. On re-appreciation of the entire evidence on record, the High Court reversed the conviction of the respondent and acquitted him. The High Court took note of the fact that the case is one of circumstantial evidence. The High Court also discussed about the doubt in the prosecution case in view of the conflicting versions regarding recovery of the weapon used for committing the offence. The High Court further considered the evidence of PW-15, Chotu Khan, and PW-25, Manju to come to the conclusion that the respondent is entitled to benefit of doubt.

5. We decline to interfere as there is no perversity in the judgment of the High Court.

6. The appeal is accordingly dismissed.
