1. Heard.
2. Learned counsel for the respondents prays for and is granted four weeks finally to file a counter affidavit. The counter affidavit shall, apart from answering the averments made in the special leave petitions, also state whether any departmental action based on the incident in-question was initiated against the respondents and if so the orders passed in that regard finally.
3. Learned counsel for the petitioner-State shall also take instructions and file an affidavit whether the incident in-question and the alleged misdemeanour of the respondents was reported for any departmental action to the higher-ups in the Customs Department concerned and if so what response/action if any was taken by the Customs Authorities. In case no such information was furnished, the same may now be furnished to the Customs Authorities to enable the Authorities to examine the matter and take a decision whether suitable departmental proceedings can be initiated against the respondents. Needful be done within four weeks by the petitioner-State.
