1. Since the admission of the petition was on 01.06.2018, Section 12A, The Insolvency and Bankruptcy Code, 2016 enacted with effect from 06.06.2018 will not come into the picture.
2. In this view of the matter, we set-aside the order dated 01.06.2018 passed by the National Company Law Tribunal, Allahabad Bench and the impugned interim order dated 26.07.2018 passed by the National Company Law Appellate Tribunal, New Delhi and take on record the Memo of Settlement that has since been arrived at between the parties on 31.07.2018.
3. The appeal is disposed of accordingly.
