1. Heard Mr. Tushar Mehta, learned Solicitor General of India who has concluded his submissions.
2. Let the matters be posted on 15th February, 2019 to hear the submissions on behalf of the respondents.
3. Mr. R. Basant, learned senior counsel appearing for respondent No. 1 in T.P.(Crl.) No. 35/2019 submits that his client would prefer an application for bail before the concerned Court namely, District & Sessions Judge-cum-Special judge, Gurugram. The learned Solicitor General of India has no objection if such application is so preferred.
4. The respondent No. 1 in T.P.(Crl.) No. 35/2019 may prefer application for bail and if such an application is preferred, the concerned court in question may consider the matter on merits without being influenced by any observations in the order of the High Court, impugned herein.
5. It is made clear that we have not expressed any opinion on the merits of the case which shall be gone into independently.
