The Order of the court was delivered by
Order
1. Heard learned counsel for the parties.
2. The main grievance of the respondent-complainant is that a sum of Rs. 1.34 crores deposited with the petitioners has not been returned. Since the amount was by way of security, this amounted misappropriation.
3. Learned counsel for the petitioners has fairly stated that the amount of Rs. 1.34 crores deposited will be returned within a period of six weeks from today in full and final settlement of the claim of the respondent(s). In the peculiar facts and circumstances of the present case, we are of the view that there is no justification to continue the criminal proceedings against the petitioners. The same will stand closed.
4. This order will not affect any other proceeding which may be dealt with independently in accordance with law.
5. The special leave petitions are, accordingly, disposed of.
6. Pending application(s), if any, shall also stand disposed of.
