3. Having heard learned counsel for the parties, it is directed that the appellant shall be enlarged on bail in connection with Case Crime No. 428/2017 registered at Police Station Gulariha, District Gorakhpur, on such terms and conditions to be imposed by the learned trial Judge.

4. The appeal is accordingly allowed and the impugned order passed by the High Court is set aside.
