Order
1. Learned Additional Solicitor General has filed an affidavit on behalf of Union of India indicating the status of progress of installation of CCTV Cameras in all subordinate Courts as well as in all the Tribunals. The original copy of affidavit may be filed in the Registry during the course of the day.
2. We find that the Ministry of Justice has taken commendable steps in the matter in coordinating the implementation of the direction of this Court. The Ministry of Law has coordinated the implementation of the order with regard to the Tribunals. However, it appears that lot of work still remains to be done. In respect of some Tribunals such as Debt Recovery Tribunals, ITAT, CEGAT, Consumer Fora, even information has not so far been collected.
3. The authorities may consider provision for terminal availability with appropriate superior authority of Court/Tribunal with regard to places which are not manned by appropriate higher rank authority at the place where CCTV Camera is installed. Decision in this regard may be taken at the level of High Court with regard to Courts and concerned coordinating Ministry with regard to Tribunals.
4. We find from the report of the Punjab and Haryana High Court that a comprehensive plan of action has been prepared to have CCTV Cameras in all Courts in four phases. The said model, may as far as possible, be adopted, if found viable at other places. A copy of this report may be put on the website of the Ministry of Justice and the Ministry of Justice to facilitate coordination with all the High Courts and Tribunals.
5. We are of the view that proposal to connect live recordings with National Judicial Data Grid may also require consideration to which a response may be given by the Union of India.
6. To oversee further progress in the matter, list for further consideration on 11th December, 2017.
7. The status report of the further progress may be furnished on the next date of hearing.
