1. In view of the judgment passed in Omprakash v. Laxminarayan1, the question of possession would not be relevant, a position which cannot be disputed by learned Senior Counsel for the petitioner.

1. In view of the judgment passed in Omprakash v. Laxminarayan1, the question of possession would not be relevant, a position which cannot be disputed by learned Senior Counsel for the petitioner. We are not prepared to take a different view from that judgment for reference as pleaded by learned counsel.
