(Ranjan Gogoi and R. Banumathi, JJ.)

Munroz __________________________________________ Appellant

v.

State of Madhya Pradesh ___________________________ Respondent

Criminal Appeal No. 806 of 2018 [Arising out of SLP (Crl.) No. 3734/2018], decided on July 2, 2018

The Order of the court was delivered by

Order

1. Leave granted.

2. We have heard learned counsel for the appellant. None has appeared on behalf of the respondent-State of Madhya Pradesh in spite of due service of notice.

3. The challenge in this appeal is limited to the condition No. 3 of the order dated 26.10.2017 granting bail to the accused-appellant.

4. In terms of the said condition, the accused who is a resident of Belgaum, Karnataka is required to report to the Police Station in Indore in Madhya Pradesh on second Wednesday of each month. Keeping in mind the huge distance between the residence of the accused-appellant and the police station at Indore and the time that would be taken to travel, we are of the view that condition No. 3 of the order dated 26.10.2017 should be modified by requiring the accused-appellant to report to the nearest Police Station which is Mal-Maruti, Belgaum, Karnataka on second Wednesday of each month as directed by the High Court. We order accordingly.

5. The order of the High Court is accordingly modified and the appeal is allowed as indicated above.
