1. We have heard learned counsel for the parties.
2. Mr. Mukesh Suryan, Chairman, Wards Committee, Najafgarh is present in Court today and he has tendered an unconditional apology. However, we find from the affidavit filed by him that he is also trying to justify his actions. This cannot be accepted.
3. Mr. R.S. Suri, learned senior counsel appearing on behalf of Mr. Mukesh Suryan, says that he will file a fresh affidavit tendering an unconditional apology.
4. The needful be done within three days.
5. Insofar as the transfer of Mr. Vishvender Singh from the position of the Deputy Commissioner (Najafgarh Zone) is concerned, we had occasion to see the relevant file which was produced by Mr. Sanjiv Sen, learned senior counsel appearing on behalf of the South Delhi Municipal Corporation. We have also seen the affidavit filed by the Additional Commissioner of the South Delhi Municipal Corporation.
6. Looking to the totality of the facts, we have serious reservations whether the transfer of Mr. Vishvender Singh was bona fide and not at the instance of Mr. Mukesh Suryan. However, we do not propose to go into this matter in further detail.
7. In any event, it is directed that Mr. Vishvender Singh be restored to the position of the Deputy Commissioner (Najafgarh zone) within 24 hours from today and he will complete his normal tenure in that position.
8. List the matter on 6th August, 2018.
9. Mr. Mukesh Suryan should remain present in Court on 6th August, 2018.
