1. Heard learned counsel for the petitioner.
2. The special leave petition is dismissed.
3. However, while dealing with the application under Section 439 of the Code of Criminal Procedure, the concerned court shall not be influenced by any of the observations made by the court at the time of cancellation of the anticipatory bail. Be it clarified, entertaining a prayer under Section 438 Cr.P.C. is different than dealing with an application under Section 439 Cr.P.C.
