The Order of the court was delivered by
Order
1. We have heard the learned ASG, learned counsel for the petitioner, learned counsel for the intervenors and learned counsel appearing for the Municipal Corporations. We have also heard the officers of the Municipal Corporations.
2. It appears after hearing all the parties that there are four kinds of waste that are generated in houses/households:
(1) Wet Waste which is compostable and includes items like vegetables, food items etc.
(2) Dry Waste which can be segregated into two:
(i) Non-biodegradable items which includes plastic, glass, aluminium foil etc.
(ii) Biodegradable items which includes paper etc.
(3) Hazardous Waste which includes broken tube-lights, LeD bulbs, sanitary napkins etc.
(4) Construction and Building Waste which includes debris etc.
3. It appears that these four kinds of waste need to be segregated for a proper management of solid waste in the city.
4. It is stated by the officers who are present in the Court today that some sort of a pilot project has been launched in Green Park, Defence Colony, Maharani Bagh and Lajpat Nagar.
5. We would like to have full details of this pilot project including when it was conceived and how it is being managed. We would also require the following information with regard to the pilot project:—
(i) actual implementation of the pilot project on the ground level including feed back that has been received;
(ii) the problems being faced in the implementation of the pilot project from different colonies;
(iii) what are the proposed solutions that the Municipal Corporations have for tackling the problems on a consideration of the feed back that has been received.
(iv) Whether an awareness campaign can be launched in these four colonies and indeed throughout the city to bring about awareness on the management of household solid waste.
(v) What is expected of the households for effective implementation of the segregation plan.
6. All these details should be made ready within a week from today and in any case on or before 14th August, 2018.
7. The details and information should be circulated to all the learned counsel as well as to this Court on or before 14th August, 2018 so that learned counsel can take the benefit of going through the details.
8. List the matter on 17th August, 2018.
9. Learned counsel for the petitioner says that reports were required to be furnished to us by today in terms of the last order but are not yet ready. He will also ensure that the reports are made ready by 14th August, 2018 and circulated to all concerned.
10. Learned counsel for the applicant appearing in I.A. No. 10736/2018 has drawn our attention to the order dated 22.12.2016 passed by the National Green Tribunal.
11. On the next date of hearing, we will also consider the submissions with regard to alternative land fill sites in Sonia Vihar and Ghonda Gujjran.
12. We request the NGT not to proceed further in the similar matters including in the case of Vardhman Kaushik v. UOI, Almitra H. Patel v. UOI, Kudrat Sandhu v. Govt. of NCT of Delhi.
13. The affidavits filed by the States be returned.
