1. Heard the learned Senior Counsel appearing for the appellant.
2. By an order dated 08.01.2018, the National Company Law Tribunal admitted the petition by an operational creditor for an amount of Rs. 1.67 Crores. The impugned order dated 22.01.2018 merely adjourned the matter presumably so that the parties could approach this Court in view of the fact that they had, by that date, entered into a Settlement Agreement dated 18.01.2018.
3. We take the said Settlement Agreement dated 18.01.2018 on record, and by using our powers under Article 142 of the Constitution of India, set aside the order dated 08.01.2018 passed by the National Company Law Tribunal.
4. Accordingly, the appeal is allowed.
5. Pending applications filed in the matter stand disposed of.
