After hearing learned counsel for the parties, we are of the view that it might be appropriate if the petitioner – Bank re-considers the entire issue in the light of the representation made by the respondent.

1. After hearing learned counsel for the parties, we are of the view that it might be appropriate if the petitioner – Bank re-considers the entire issue in the light of the representation made by the respondent. The reconsideration should take place through a speaking order within a period of six weeks from today without being influenced by the order passed by the High Court. The respondent may give a fresh representation within a week from today.

2. The special leave petition stands disposed of.
