1. Issue notice returnable within two weeks.
2. Dasti, in addition, is also permitted.
3. Mr. Kapil Sibal, learned senior counsel for the petitioner submits that in terms of order dated 09.10.2014 passed by the High Court which is reiterated by its order dated 26.11.2014, the petitioner is required to file an undertaking before the High Court. He submits that since the matter is now pending before this Court the petitioner be permitted to file the required undertaking in this Court. He further submits that the petitioner shall carry out any repair work that this Court may direct after hearing the respondents.
4. In the circumstances we permit the petitioner to file the undertaking required in terms of order dated 09.10.2014 passed by the High Court before this Court within one week. In that view therefore we stay further proceedings before the High Court subject to the condition that the petitioner shall strictly comply with the directions of the High Court regarding collection and deposit of the toll tax amount in a schedule Bank and to refrain from withdrawing the same pending further orders.
