CRLMP. 1108/2016 in Criminal Appeal No(s). 130/2012, decided on February 5, 2016
The Order of the court was delivered by
Order
1. Learned counsel for the appellant-applicant has invited our attention to the fact that when the matter came up for hearing on 12.04.2013, this Court, while rejecting the application for bail, directed that the main case be listed for hearing in July, 2013.
2. Despite more than two years having elapsed since then, the appeal has not come up for hearing. The appellant has been in jail for a period of about 11 years.
3. In view of the above, we consider it just and appropriate to direct release of the appellant.
4. Accordingly, the appellant-applicant is ordered to be released on bail to the satisfaction of the trial Court, on such terms and conditions as it may deem fit.
5. Crl.M.P. for bail is disposed of.
