1. Leave granted.
2. Respondent no. 1 and 2 have appeared through their counsel.
3. We have heard the matter and gone through the record. We find that it is a fit case where both the suits one filed by the petitioner against respondent no. 2 and other filed by respondent no. 1 against the petitioner should be tried together. We, accordingly, set aside the order of the High Court as well as the Trial Court passed in the application filed by the appellant for the aforesaid purpose and allow the said application.
4. We are conscious of the fact that there are more respondents except respondent nos. 1 and 2 and we have not issued notice to respondent nos. 3 to 5, only because of the reason that issuing of notice may unnecessary delay the proceedings in the matter. However, in case, respondent nos. 3 to 5 still have any objection, they may always approach this Court.
5. With the aforesaid observations, this appeal stands disposed of.
