The Judgment of the Court was delivered by

J.M. Shelat, J.:—

 

1. In this case, the petitioner made his representation on 7-7-1969. It is admitted by the learned counsel appearing for the State that it was considered by the State Government on 27-8-1969, that is to say, after one month and 20 days. Admittedly, the State Government has not shown any reasons as to why there was such an inordinate delay.

 

2. That being the position, following the judgment which we have delivered today in Khairul Haque v. State of W.B.1 we allow the petition and direct that the petitioner be released forthwith.
